When can a CE mark be applied?

 


Machinery Directive (MD)

CE marking against the requirements of the Machinery Directive is already compulsory by national legislation in all member states.  Power operated doors and shutters must be CE marked to signify compliance with the Machinery Directive when commissioned on site. 

Construction Products Directive  (CPD) 

Although power operated doors are required also to meet the requirements of the CPD, the CE mark cannot cover this Directive until the harmonised product standards have been concluded.

The product standard to cover industrial, commercial and garage doors & gates for non-fire resisting/smoke control characteristics (ie prEN 13241-1) will become the first to receive publication.  The formal vote is to be initiated during 2002.

Following the date of availability of the harmonised product standard (hEN 13241-1) from CEN, the European Commission will publish its reference in the OJEC (Official Journal of the European Communities). Nine months after the date of availability of the hEN, a period of co-existence will then begin during which manufacturers within the EU will be free to use the new hENs and apply CE marking accordingly, or continue to use the old national standards without CE marking.

The period of co-existence is twelve months for the hEN 13241-1. 
When the harmonised product standard for fire resisting/smoke control products (hEN 13241-2) becomes available (approximately 2004) the Commission will almost certainly approve a somewhat longer period of co-existence.After the period of co-existence, conflicting national standards must be withdrawn. 

For CE marking to be applied after the co-existence period, production must comply with the specifically identified CE marking requirements in the harmonised standards.
